Motorcycle Accidents

Ask a motorcyclist why he or she rides, and the answers may paint a romantic picture. The wind, the skill, the sound of their bikes.  Or a pragmatic picture. Rising fuel costs.

Between 1995 and 2007, motorcycle registrations grew 63 percent – and fatalities more than doubled. The fatality statistics (according to the CDC) reached an all time high for motorcyclists.

According to the National Highway Transportation Safety Administration, motorcyclists are 25 times more likely to be involved in a fatal accident than passenger car drivers and passengers. The most recent statistics revealed that 11 percent of all roadway accidents in the US involve motorcycles – and that number – if trends continue – will climb.

Motorcycle riders in their 20’s sustained most injuries statistically, but as the number of older motorcycle riders continues to grow, anticipation of marked increase in older age groups is anticipated.

One of our clients crashed his bike on the Oregon Coast Highway. When the motorcycle was recovered and our investigators viewed it, it appeared that the rear spoked wheel failed.   Our case turned on whether the wheel failed before our client left the road – or after.  Through reconstruction of the facts of the accident, and a metallurgical analysis of the parts of the wheel, we were able to prove that the wheel failed first, causing the accident. The case settled successfully prior to trial.

Another client was hit by a car that accelerated off the shoulder into the path of the motorcycle – causing our client to swerve off the road and into a tree. The injured man retained our firm immediately, and we were able to preserve the evidence within a day of the accident. Two experienced accident reconstructionists hired by our firm sorted out the facts. When informed of the information, the defense’s insurance company settled promptly.
